1. INTRODUCTION & ACKNOWLEDGMENT
This Liability Waiver and Responsibility Agreement (the "Agreement") is entered into by the undersigned participant ("Participant") in consideration for being permitted to use the facilities of The Bridge Improv Theater ("Theater") for rehearsals, performances, classes, or any related activities (the "Activities").
Participant acknowledges that participation in these Activities involves inherent risks, including but not limited to physical exertion, potential injuries, and interactions with other participants. Additionally, Participant acknowledges responsibility for any damage to Theater property or missing concession inventory during their rental or usage period, particularly if no staff is present at the front desk.
2. ASSUMPTION OF RISK & RELEASE OF LIABILITY
Participant voluntarily assumes all risks associated with participation in the Activities, including risks of bodily injury, emotional distress, or property damage. Participant hereby releases, waives, and discharges The Bridge Improv Theater, its owners, employees, and affiliates (collectively, the "Released Parties") from any and all claims, liabilities, damages, costs, or expenses arising from injuries or harm suffered while participating in the Activities, including those caused by the negligence of the Released Parties, except in cases of gross negligence or willful misconduct.
3. RESPONSIBILITY FOR DAMAGE & MISSING INVENTORY
Participant agrees to respect and care for all Theater property, including but not limited to the stage, seating, equipment, props, and concession inventory. Participant acknowledges that:
Any damage to Theater property beyond reasonable wear and tear may result in financial liability for repair or replacement costs.
Any missing or unaccounted-for concession inventory during their rental or usage period may be subject to charges at the Theater’s discretion.
The Theater reserves the right to assess and determine liability for damages or missing items.
4. CODE OF CONDUCT & FACILITY USAGE
Participant agrees to:
Use the Theater space responsibly and in accordance with Theater guidelines.
Refrain from reckless, destructive, or negligent behavior.
Report any damage or issues immediately to Theater staff.
The Theater reserves the right to revoke access to the facilities for any Participant who fails to adhere to these guidelines.
5. INDEMNIFICATION
Participant agrees to indemnify and hold harmless the Released Parties from any claims, losses, damages, or expenses arising from Participant’s actions, including but not limited to damage to property or third-party claims related to the Participant’s conduct.
6. SEVERABILITY & GOVERNING LAW
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect. This Agreement shall be governed by the laws of the state of Arizona, and any legal action arising out of this Agreement shall be brought in the courts of the City of Mesa.
7. ACKNOWLEDGMENT AND SIGNATURE
By signing below, Participant acknowledges that they have read and understand this Agreement, voluntarily assume all risks, and agree to be bound by its terms.
